Denmark Introduces Retroactive Reporting of “Free Rider Quantities”
Denmark is offering companies a pragmatic path back to EPR compliance: manufacturers and importers can now retroactively report so-called “Free Rider Quantities” — meaning quantities that were placed on the market without the required registration or reporting being in place at the time.
The new procedure introduced by Dansk Producentansvar is particularly relevant for companies that identified or implemented their EPR obligations in Denmark late or only partially. According to the current rules, quantities can be reported retroactively for up to five years without additional penalty fees or increased administrative charges. Companies should also consider that obligations for foreign companies, for example for batteries, have only applied since 2025.
Why This Matters
The Danish solution gives companies the opportunity to close existing compliance gaps without facing immediate sanctions. This is especially important for businesses operating across borders and dealing with differing national EPR requirements throughout Europe.
Compared to other European countries, Denmark is taking a relatively pragmatic approach:
- Germany, Italy, and Spain: Electrical and electronic equipment (EEE) and batteries may generally only be sold with a valid registration. Retroactive legalization of already marketed quantities is practically not possible.
- Belgium and France: Companies registering now may be required to report quantities retroactively for up to seven years.
- Poland: Retroactive reporting is possible for batteries and packaging, but not for electrical and electronic equipment.
In these countries, companies may face fines, sales bans, or marketplace restrictions.

- whether historical quantities were placed on the market without registration, and
- whether all relevant product categories are correctly registered and reported.
