The European Battery Regulation (2023/1542/EU) contains various opening clauses for national legislators, while also obliging Member States to implement specific regulatory measures. As a result, there is a need to adapt national battery law.
On 6 November 2024, the German government adopted the draft law to align national battery law with the European Battery Regulation (Battery Law EU Adaptation Act). The Battery Law EU Adaptation Act is set to replace the German Battery Act (BattG) and is scheduled to come into force by no later than 18 August 2025.
Among other provisions, the draft requires non-German-based producers to appoint an authorised representative. It also mandates that all battery producers, regardless of the battery category, participate in a take-back system for extended producer responsibility.
