Mandatory Take-Back of E-Cigarettes and Vapes
As of 1 July 2026, an amendment to Germany's Electrical and Electronic Equipment Act (ElektroG) introduces a new mandatory take-back obligation for electronic cigarettes and electronic tobacco heating devices (vapes). Retailers selling these products are now required to offer consumers a free return option, regardless of whether a new device is purchased.
The new legislation addresses the growing fire risks associated with the lithium-ion batteries contained in e-cigarettes and vapes when they are disposed of improperly.
What has changed as of 1 July 2026?
The key changes include:
- A mandatory free take-back service for all retailers selling e-cigarettes and vapes.
- Consumers may return used devices without purchasing a replacement.
- No minimum store size requirement applies, meaning that kiosks, convenience stores and petrol stations are now subject to take-back obligations for waste electrical and electronic equipment (WEEE) for the first time.
- The official take-back logo must be clearly displayed at every collection point.
The objective is to ensure the safe collection of these products at the point of sale and to reduce fire hazards caused by lithium-ion batteries.
Who is affected?
The new requirements apply to all retailers of e-cigarettes and vapes, including disposable vapes. This includes specialist retailers as well as businesses such as kiosks and petrol stations, which have generally not previously been subject to WEEE take-back obligations. For many of these newly obligated businesses, the legislation raises practical questions regarding the marking of collection points, customer information requirements, and the proper handling and disposal of collected devices.
The changes also have indirect implications for public waste management authorities, which should expect to receive increasing quantities of e-cigarettes and vapes collected by retailers, kiosks and petrol stations for subsequent treatment and disposal.
