Changes in Lighting Equipment
stiftung ear reports:
The upcoming new German WEEE law brings up the need for changes in the b2c category of Lighting Equipment. The Types of Equipment will be newly defined as follows:
5.1.1 Gas discharge lamps, for the use in private households
5.1.2 Lamps, except gas discharge lamps, with non-exchangeable, fixed light sources, for the use in private households (e.g. LED lamps)
5.2 Luminaries and other lighting equipment or devices for the dispersion of light
Consequently
- Lamps, with the exception of gas discharge lamps will be shifted into the new Type of Equipment 5.1.2
- Luminaires with non-exchangeable, fixed light sources, for the use in private households, are now subject to registration as luminaries in the Type of Equipment 5.2
- Luminaires with exchangeable light sources now fall into the registration scope and are subject to registration in the Type of Equipment 5.2
If you market lamps or luminaires, please check your product range.
Here are a few example scenarios displayed by stiftung ear:
- You only sell gas discharge lamps, which are not connected to a luminary and you are registered in the Type of Equipment 5.1
- No action required
- You only sell luminaires with non-exchangeable, fixed light sources and you are already registered in the Type of Equipment 5.2
- No action required
- You sell other type of lamps / light sources
- Verification required
Should you come to the conclusion that you require a different or an additional registration, you have to inform stiftung ear within a three month period after the new law came into effect. Until the feedback of stiftung ear, report your quantities as usual.
- You sell luminaries
- Verification required
Should you not be registered in the Type of Equipment 5.2 Luminaires and devices for the dispersion of light for the use in private households, in which luminaries will become subject to registration with the new law, please register as soon as the law comes into effect to make sure that you are registered by the end of the three months transitional period.
