New draft law to adapt German battery law to the EU regulation
The BMUV has presented a draft bill for a law to adapt battery legislation to EU Regulation (EU) 2023/1542 (EU-BattVO). The bill aims to transpose the new requirements of the EU-BattVO into national law. To this end, the existing Battery Act (BattG) will be repealed and replaced by a new Battery Implementation Act (BattDG). The BattDG specifies which authorities are responsible for enforcing the various legal aspects governed by the EU-BattVO and includes penalty provisions for violations of the BattVO and BattDG. Furthermore, it is planned to maintain and further develop the proven structures for the return and disposal of used batteries.
However, it should be noted that the draft bill has not yet been coordinated with the federal government.
