Update Batteriedurchführungsgesetz (BattDG)
The Federal Ministry for the Environment, Climate Protection, Nature Conservation and Nuclear Safety (BMUKN) today presented a draft bill to amend battery law in line with Regulation (EU) 2023/1542.
Bitkom's statement can be found here. (In German)
Background:
Although the Battery Regulation applies directly in all member states as an EU regulation, it contains numerous opening clauses and specific regulatory mandates that require member states to enact supplementary national legislation. This makes it necessary to adapt German battery law.
In order to meet these requirements, a draft bill for the Battery Law EU Adaptation Act (BattDG) was already submitted in Germany during the last legislative period, which is intended to replace the previous BattG. The draft bill was published in May 2024, followed by the government draft in November of the same year. However, due to the dissolution of the governing coalition, the law could not be passed and is now being taken up again in the current legislative period.
